How does illness affect holidays?

  • If, at the start of his/her annual holiday, an employee is incapacitated because of illness, accident or childbirth, the holiday must be postponed at the request of the employee.
  • The employee also has a right to have the holiday postponed if it is known that during his/her holiday the employee has to receive medical treatment.
  • If the incapacity for work resulting from illness, accident or childbirth starts during a period of annual holiday and continues for an uninterrupted period of more than seven days, the portion of the holiday exceeding seven days must be postponed if the employee so requests without undue delay.
  • The employee must, at the request of the employer, present a reliable account of his/her incapacity for work.
